An emergency filing from Olivier Martinez has put new restrictions on Halle Berry’s contact with their 12-year-old son, Maceo. A judge granted Martinez a temporary restraining order Thursday (Oct. 1) after he accused Berry of physically attacking the child during a September 26 confrontation. According to TMZ, Berry must stay 100 yards away from Martinez and is limited to her existing court-ordered visitation with Maceo until an October 16 hearing.
Martinez alleges Maceo called him after Berry jumped on him, grabbed his neck, and choked him during an argument at her home. The filing claims she shouted, “Who is dominant now?” during the confrontation. People reports Martinez also accused Berry of previous physical and verbal incidents involving their son. Berry had not publicly responded to the allegations at the time of publication.
The court also ordered both parents into confidential mediation as the custody fight moves forward. Under the temporary order, Berry can continue seeing Maceo two days each week and every other weekend, but the filing also requires that she not drink alcohol or use other substances around him. Sobriety testing may be required before or during visitation.

Olivier Martinez Is Seeking Sole Custody
The reported September incident is now part of a larger request from Martinez to take sole custody of Maceo. His filing includes alleged text messages from the child asking to be picked up after the confrontation, along with messages Martinez says he exchanged with Berry afterward. One message attributed to Berry reads, “I feel terrible about what happened last night as I know he does as well,” though the filing does not establish that she was admitting to Martinez’s version of events.
Moreover, their co-parenting relationship was already strained well before the restraining order. Berry and Martinez finalized their divorce in 2023 with joint legal custody of Maceo. People reported that they later agreed to co-parenting therapy in 2024 in an effort to resolve ongoing disputes.
Martinez’s new filing moves that conflict into much more serious territory. He is no longer asking the court to help manage disagreements between the two parents. He is asking a judge to change who has primary control over their son’s care while accusing Berry of conduct she has not yet publicly addressed.
