Drake is being sued over the sample used at the beginning of "Pound Cake".

The intro to Drake's "Pound Cake"-- the closing track from Nothing Was The Same --featured a very prominent sample from a 1982 Jazz song, "Jimmy Smith Rap", performed by Jimmy Smith. The clip used in the song is not actually musical, but simply a spoken word interlude about the joys of recording.

While the liner notes give credit to the original performers, suggesting that permission for the use of the sample was granted, Jimmy Smith's estate still feels some type of way about it.

According to the owner's of the song, Drake did NOT have permission to use the clip, and they're now looking for over $300,000 in compensation from Drake, Cash Money records, and a few others involved.

That's all we know for the time being. Stay tuned for updates.
