Troy Ave has been incarcerated since May 26, when he was arrested at the hospital for his alleged role in the shooting that took place the night before at a T.I. concert at NYC's Irving Plaza. On the same day, surveillance footage surfaced showing Troy busting into a backstage room at the concert and opening fire. Despite multiple gunshots, there was only one casualty of the shooting, and that was Ronald McPhatter, an affiliate of Troy's known as B$B Banga. Troy was charged with attempted murder, though it was initially unclear if police presumed him to be responsible for the killing of McPhatter. According to TMZ, it has now been reported that Troy has not been indicted for the killing of McPhatter; thus, he will not face charges of first degree murder.
That's not to say his prospects are looking auspicious -- he has still been indicted on five felonies, reports TMZ, which could earn him a prison sentence of multiple decades. Legal documents apparently reveal that the grand jury has indicted Troy on charges of second degree murder as well as four counts of criminal possession of a weapon.
Ballistics testing has reportedly proven that the bullets that killed McPhatter did not come from the weapon that Troy was seen firing in the Irving Plaza surveillance footage.
Troy's lawyer, Scott Leemon, tells TMZ that he plans to request that his client be released on bail at his next hearing, which is set to take place later this week. "The video does not show everything nor explain what happened in the VIP room before Troy came running out, as a victim, after he was shot," said Leemon.
