Just 24 hours after news broke that rapper Gucci Mane -- who spent a good part of 2009 and 2010 locked up -- may be returning to jail, we've now discovered that the Atlanta-bred emcee was committed into a mental health treatment facility. According to TMZ, Gucci appeared in a Georgia courtroom yesterday and filed a "Special Plea of Mental Incompetency." The rapper claims that he is unable to "intelligently participate in the probation revocation hearing."

Apparently, a judge bought Gucci's story and he was ordered into custody where he's awaiting an evaluation. The rapper -- born Radric Davis -- may be able to avoid spending 17 months in jail if he's found to be mentally incompetent.

Gucci is also set to appear at a hearing on Jan. 24 in Fulton County Superior Court. Gucci is said to be working on his fourth studio album, 'The State vs. Radric Davis 2: The Verdict,' which is scheduled for release this year. If convicted, this will mark the second time the rapper had to release a project while behind bars. Unfortunately, he won't be the first rapper to do so, especially in recent years. In 2010 alone, T.I. released his 'No Mercy' LP while serving time for violating probation and Lil Wayne dropped his chart-topping 'I Am Not a Human Being' while serving out his sentence.
